This document outlines how you may or may not use the services made available to you by Kiano.Net Ltd. (Kiano.Net, "we", "us", "our").

How you may use Kiano.Net

  • Any home computer user may use our services as long as they aren't prohibited below.

Conditions prohibited on Kiano.Net

  • No 'businesses for profit' may use our services.

The Kiano.Net Terms of Service (sometimes named the Terms of Use, Terms of Service, TOS or TOU) document below describes how Kiano.Net ("we", "us" or "our") collects, stores, uses and discloses your personal information, how you should use Kiano.Net, and the necessary copyright information for people using or sending Kiano.Net data.
All Kiano.Net websites worldwide operate under these Terms of Service, and are subject to the requirements of applicable local law.
By viewing or accessing any part of any Kiano.Net website (you are Kiano.Net user), you expressly consent to the collection, storage, use and disclosure of your personal information by Kiano.Net and agree that you understand the Terms of Service outlined in this document.
This document is valid from Sunday 5 October 2008 and is effective upon any user of Kiano.Net.

1. Use of Kiano.Net
1.1a. Clause 1.1b applies to all Kiano.Net content including the information, pages, documents, names, images, pictures, logos, icons and data created (and most of the information that is edited or hosted).
1.1b. You may not copy, reproduce, republish, download, post, broadcast, transmit, or otherwise use Kiano.Net content (the information, pages, documents, names, images, pictures, logos, icons and data created or edited or hosted by Kiano.Net) in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from any Kiano.Net content except for your own personal, non-commercial use. Any other use of Kiano.Net content requires the prior written permission of Kiano.Net. See clause 4.
1.2. You agree to use Kiano.Net only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of Kiano.Net. Prohibited behaviour includes (but is not limited to) harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of information and content within Kiano.Net.
1.3. Kiano.Net content which is all the information, pages, documents, names, images, pictures, logos, icons and data, whether created or edited or hosted by Kiano.Net is provided "AS IS" and on an "WHEN AVAILABLE" basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
1.4. Kiano.Net does not warrant that functions contained in Kiano.Net content (the information, pages, documents, names, images, pictures, logos, icons and data created or edited or hosted by Kiano.Net) will be uninterrupted, error free, that defects will be corrected, or that Kiano.Net or the server that makes it available are free of bugs. Kiano.Net will always try to test and check all downloads and pages for such viruses or bugs, no warranty is given. Kiano.Net reserves the right to close or disable any part (or all) of Kiano.Net, for any purpose. Prior notice will be given in most circumstances, but is not guaranteed (eg. Kiano.Net is normally closed on Remembrance Sunday from 11am until noon).
1.5. Under no circumstances will Kiano.Net be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise) including but not limited to: (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of Kiano.Net regardless of the form of action.

2. Your own work
2.1a. Clause 2.1b applies to all Kiano.Net content: including the information, pages, documents, names, images, pictures, logos, icons and data that is created (and most of the information that is edited or hosted) by Kiano.Net. Clause 2.1b will not apply to any data that is submitted and a different license is issued to the author by email, records will be kept of this. Clause 2.1b does not always apply to any work collected by Kiano.Net and not directly uploaded by the author, as Kiano.Net does incorporate some third-party content.
2.1b. Where you are invited to submit any contribution to Kiano.Net (including but not limited to any text, photographs, graphics, video or audio) you agree, by submitting your contribution, to grant Kiano.Net a perpetual, royalty-free, non-exclusive, sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution, and in accordance with privacy restrictions set out in Kiano.Net's Terms of Service. If you do not want to grant to Kiano.Net the rights set out above, please contact us prior to submitting your contribution to Kiano.Net.
2.2. By submitting your contribution to Kiano.Net, you warrant that your contribution: is your own original work and that you have the right to make it available to Kiano.Net for all the purposes specified above; is not defamatory; does not infringe any law; and indemnify Kiano.Net against all legal fees, damages and other expenses that may be incurred by Kiano.Net as a result of your breach of the above warranty; and waive any moral rights in your contribution for the purposes of its submission to and publication on Kiano.Net and the purposes specified above.
2.3. Contributions to any of our services (eg. Kiano PC live help) must be civil and tasteful. No disruptive, offensive or abusive behaviour: contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble. Unlawful or objectionable content: unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable. If you use multiple 'logins' or 'accounts' for the purpose of disrupting Kiano.Net or annoying other users you may have action taken against you or your IP address (you/it may be blocked). No spamming material: we don't allow the submission of the same or very similar contributions many times. Please don't re-submit your contribution to more than one location on Kiano.Net, or contribute off-topic material in subject-specific areas. No advertising: unless permission has been retrieved – contact us at the Kiano.Net information pages. Contributions containing languages other than English may be removed. No impersonation. No inappropriate (e.g. vulgar, offensive etc) user names or emails. Deliberate misuse of the complaints facility is not permitted. If you persist in doing this action may be taken against you or your IP address (eg. you/it may be blocked).
2.4. Kiano.Net reserves the right to delete any contribution, not reply to any contribution, or take action against any account or author, at any time, for any breach of the Terms of Service.

3. Employment
If you are 'employed' by Kiano.Net, it means that you have helped us in some way - and it's our way of thanking you. You will be contacted prior to being listed, and have a false name listed on our 'employees’ page. You are not officially employed and do not have a job with us. You will not be paid. Not all helpers will be listed or contacted by us. The work (if any) you do for us is voluntary and you may quit at any time. Any job applications and the employees page is provided as a joke and should never be taken seriously. The list may also be wrong or out of date. Kiano.Net is not a commercial website, nor is it a business. It is an organisation run by an individual.

4. Copyright Lease
4.1. If you are seeking permission to use any of Kiano.Net's trademarks, logos, screen-shots, copyrighted designs, or other features from the Kiano.Net websites (http://www.kiano.net, https://dob.mochahost.com/~kianonet/, http://dob.mochahost.com/~kianonet/), please provide the following information to allow us to review your request:
1. Name of the organisation, company or person requesting permission;
2. Office addresses (headquarters) or personal address, with an e-mail address;
3. Country where the company or organisation is registered or where you live;
4. Name of the article or website where Kiano.Net material will appear;
5. Exact Kiano.Net materials to be used including web URLs;
6. Mock-up of the article or website in which the Kiano.Net materials will appear.
4.2. Please send this information to us by using the support system on Kiano.Net contact us.
4.3. If your request is approved, that approval will be subject to the terms stated on the email
4.4. Kiano.Net may only grant permission for the use of Kiano.Net specific material such as one logo or the Kiano.Net front page (http://www.kiano.net or https://dob.mochahost.com/~kianonet/ or http://dob.mochahost.com/~kianonet/).
4.5. Kiano.Net incorporates third party content. Kiano.Net is unable to grant permission for you to use third party content. Please contact Kiano.Net as explained in clauses 4.1 and 4.2 and we will try to tell you how to contact the appropriate third party for permission to use their content. Once your lease is granted, you will be notified by our support ticket system, and the lease will be listed below.
4.6a. The following copyright leases have been granted, which means that clause one applies to the following uses, but with the exceptions listed:
4.6b. Kiano PC - to use the Kiano PC logo, in a size no larger than 300x300 for promotional purposes. Users of Kiano.Net/Kiano PC may download any of the images listed on http://kpc.kiano.net/supus.html for personal use only. The images may not be altered, adapted or used for commercial purposes (including selling the images in any form). The images may not be used in new productions, eg. videos or watermarking. The images may be publically displayed, and shown on a screen for personal use or promotional use only. Other terms may apply, you should contact us for details.

6. Cookies
6.1. In order to enable Kiano.Net to provide you with a personalised browsing experience, this site uses 'cookie' information collection technology. "Cookies" are small pieces of information that are issued to your computer when you enter a website. Cookies are stored by your browser on your computer, and they can be used for a wide range of purposes, such as identifying your computer's previous visits to this website, and to ascertain the most popular features of this website.
6.2. Like many other websites, this website uses cookies as they enable Kiano.Net and our carefully selected third party companies, to identify your computer when you visit this website. For example, cookies make it possible for Kiano.Net to identify and automatically log in registered users of certain services on this website without the need for Kiano.Net to ask users for their registration details and password each time they visit. We may also use cookies to develop a clearer picture of which parts of this website are the most popular to its visitors, and your preferences. You are not obliged to accept cookies and you may amend your browser's settings to prevent it from accepting cookies.
6.3. Please be aware that if you do disable cookies, certain services on this website may not be available to you and your enjoyment of this website may be impaired. You can always reactivate them at any time, see our help section.
6.4. We would like to make clear that third parties may be placing and reading cookies on Kiano.Net's users’ browser, or using web beacons to collect information, in the course of ads being served on this website.

7. General
Users under 13 years of age must get your parent/guardian's permission whenever you provide confidential information to Kiano.Net. Users without this consent are not allowed to provide Kiano.Net with any confidential information (as outlined in 5.2.)
Some links from Kiano.Net are not to Kiano.Net websites. We try to make sure the links are suitable for all ages, but we have no guarantee of this. You should report any bad links from Kiano.Net to our support ticket system. See contact us.
If you do not agree with the Terms of Service outlined in this document or if you don’t understand it, you should not use Kiano.Net in any way.
Kiano.Net may update the Terms of Service document from time to time. Any changes (except for grammatical or spelling changes) will be outlined on our Homepage.

8. Free Support Terms
The following terms as shown below (as clause 8.) only apply to any use of Kiano PC. However, the entire Terms of Service document applies to the use of Kiano PC, not just clause 8. This includes accessing http://www.kiano.net/kpc/ or http://kpc.kiano.net/, using our support ticket system at http://core.kiano.net/supporttick/, using our live chat system at http://core.kiano.net/livechat, or contacting us via. Crossloop (http://www.crossloop.com), Skype (skype.kiano), MSN/Windows Live Messenger (kianopc@live.co.uk) or Yahoo! Messenger (kianopc).
8.1. 3rd party terms also apply when you are using the individual services listed in 8.0. This includes but is not limited to Windows Live (http://dev.live.com/terms/tos.aspx), Yahoo! Messenger (http://info.yahoo.com/legal/us/yahoo/messenger/messengertos/messengertos-279.html), Skype (http://www.skype.com/legal/terms/web/), ICQ (http://www.icq.com/legal/ircqnet.html) and Crossloop (http://www.crossloop.com/ipage.htm?id=termsofservice).
8.2. You will not: (1) harass, threaten, abuse, defame, embarrass or cause distress or discomfort upon any Kiano.Net Support agent; (2) transmit via any of our communication methods as ruled in section 8, any information, data, text, files, links, software, chat, content, communication or other materials and terms of expression("Information") that are offensive, racial, discriminating, unlawful, information or instructions concerning illegal activities, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable; (3) transmit via any of our communication methods as ruled in section 8, any Information that infringes any patent, trademark, trade secret, copyright or other proprietary right; (4) disrupt the normal flow of Information on or through any of our communication methods as ruled in section 8 or otherwise act in a manner that negatively affects other customers; (5) post or transmit any unsolicited advertising, promotional materials, or any other forms of solicitation; and (6) intentionally or unintentionally violate any applicable local, state, national or international law. (7) Translate, decompile, reverse engineer, disassemble, modify, copy, alter, merge into other software, reproduce, rent, lease, lend, distribute, remarket or otherwise dispose of any of our communication methods as ruled in section 8 or any part thereof. (8) Impersonate any person, customer, Support Operator, Manager, Admin or host.
8.3. Breaching any of the rules in section 8, will result in warnings and/or a ban at the Kiano.Net Manager's discretion. If you are banned, you are prohibited to use Kiano PC or any of the services attached to Kiano PC and you must not contact Kiano PC under any circumstances. You may be fined usage costs for breaching a ban. You will be notified of any charges when you need to pay them. You may also be in breach of other laws (e.g. the computer misuse act, in the UK). You may be reported to the Police or any Governmental organisation in your and/or our country, state, town/city.
8.4. Disclaimer of warranties. You expressly agree that use of Kiano PC (which is any of our communication methods as ruled in section 8) is at your own risk. No warranty, representation, condition, undertaking or term - express or implied, statutory or otherwise - including but not limited to the condition, quality, durability, performance, accuracy, reliability, non-infringement, merchantability, or fitness for a particular purpose or use of Kiano PC (which is any of our communication methods as ruled in section 8) is given or assumed by Kiano.Net or Kiano PC . All such warranties, representations, conditions, undertakings and terms are hereby excluded. Kiano PC and Kiano.Net Makes no warranty that Kiano PC (which is any of our communication methods as ruled in section 8) will meet your requirements, or that Kiano PC (which is any of our communication methods as ruled in section 8) will be uninterrupted, timely, secure, or error free;
8.5. Kiano PC makes no representations as to the suitability of the information delivered or received on or through Kiano PC (which is any of our communication methods as ruled in section 8) for any purpose nor about its legitimacy, legality, validity, accuracy, correctness, reliability, quality, stability, completeness or currentness. All such information is solely provided by our staff at Kiano PC, which may or may not be qualified to deliver such information. The information delivered or received on or through Kiano PC (which is any of our communication methods as ruled in section 8) may not be reviewed, controlled or examined by Kiano PC. In any way before it appears on Kiano PC. Kiano PC (which is any of our communication methods as ruled in section 8) does not endorse, verify or otherwise certify the contents of any such information. Users are solely responsible for following the contents of messages from our staff and may be held legally liable or accountable for the contents of their messages or by following the information in such messages (including, without limitation, infringement of intellectual property rights).
8.6. Limitation of liability: in no event shall Kiano PC (which is any of our communication methods as ruled in section 8). Be liable to any party for any damages including without limitation, any direct, indirect, special, punitive, incidental or consequential damages (including, but not limited to, damages for loss of business profits, business interruption, loss of programs or information, loss of profits and savings and the like), or any other damages arising - in any way, shape or form - out of the availability, use, reliance on, inability to utilize or improper use of Kiano PC (which is any of our communication methods as ruled in section 8) even if Kiano PC shall have been advised of the possibility of such damages, and regardless of the form of action, whether in contract, tort, or otherwise. Because some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, the above exclusions of incidental and consequential damages may not apply to you.
8.7. In no event shall Kiano PC (which is any of our communication methods as ruled in section 8) Be liable to anyone for any delays, inaccuracies, errors or omissions with respect to the information or the transmission or delivery of all or any part thereof, for any damage arising therefrom or occasioned thereby, or for the results obtained from the use of the content of messages.
8.8. Other unacceptable use includes most business use. If you are a non-home, personal or single user, you are recommended to check with Kiano PC before using any of our services. The only way to do this is to send us an email to our online support system. Other use may be prohibited at our digression, including frequent (every day) usage, contacting us in relation to security/password/hacking/cracking or otherwise illegal matters. This may be limited or restricted. You will be informed if you breach any of the rules in section 8.8. If we do not have any of your contact information on file, we may decide to temporarily terminate your service.
